CONSUMER ONLINE BANKING AGREEMENT,
ELECTRONIC FUNDS TRANSFER
AND BILL PAYMENT DISCLOSURE
Please read the Consumer OnLine Banking Agreement and Electronic Funds Transfer (EFT) Act, and Bill Payment Disclosures that follow for Kish Bank. By clicking on the button labeled I Agree, you are indicating you:
- Are the primary account holder (tax reporting entity) on at least one of the checking accounts set forth on your application form;
- Hereby request that Kish Bank gives you access to the following services: transfers, account inquiry, stop payments, bill payment, statements, reports, customer service via email and other services that may be added in the future;
- Agree that if you authorize someone else to use your Login ID and Password, you are responsible for any use of the Consumer OnLine Banking and Bill Payment system;
- Agree to receive and review notification of your Consumer OnLine Banking transactions via electronic bank mail; and
- Agree that Kish Bank may revoke your Consumer OnLine Banking privileges at our discretion.

System Security – We are committed to providing our customers with the highest level of security available. In order to ensure that your information is protected, we have employed data encryption. Kish Bank’s Consumer OnLine Banking requires a browser capable of high-security 128-bit encryption (SSL). Without this level of security, access will be denied.

You are responsible for the installation, maintenance, and operation of your computer and your software. The risk of error, failure, or nonperformance is incurred by you including the risk that you do not operate your computer or your software correctly. Kish Bank is not responsible for any errors or failures from any malfunction of your computer or your software; computer virus related problems that may be associated with the use of the Consumer OnLine Banking and OnLine Bill Payment system; and shall have no liability to you for any damages or other loss, direct or consequential, which you may suffer or incur by reason of your use of your computer or your software.
Hours of Operation – For purposes of Consumer OnLine Banking and Bill Payment transactions, our business days are Monday thru Friday, excluding holidays. Consumer OnLine Banking and Bill Payment services are available twenty-four (24) hours a day, seven (7) days a week, except during special maintenance periods. All bill payment requests received after 9:00 PM EST and all transfers and stop payments requests received after 9:00 PM EST on a business day will be processed on the next business day.
Electronic Funds Transfer Act Disclosure
In this agreement, “you”, “your” and “yours” means the person who authorized the electronic fund transfer including anyone else you allow to do so. “We”, “us”, “our” and “Bank” refer to Kish Bank. Business day refers to Monday through Friday excluding Holidays. Consumer OnLine Banking may be referred to as COB. The Consumer OnLine Banking and Bill Payment Agreement sets forth the terms and conditions of the agreement between you, the person or persons authorized by you to transact business for you through Consumer OnLine Banking and Bill Payment services. It also describes the rights and obligations of Kish Bank related to Consumer OnLine Banking and Bill Payment transactions. By requesting and using one of these services, you agree to comply with the terms and conditions of this Agreement, which remains in effect until it is terminated by you or Kish Bank. The terms and conditions of the deposit agreements and disclosures for each of your Kish Bank account(s) as well as your other agreements with Kish Bank such as loans; continue to apply notwithstanding anything to the contrary in this Agreement.
Your Liability – Notify us IMMEDIATELY if you believe your account may be or has been subject to unauthorized electronic fund transfers. Notifying us by telephone is the best way to minimize your potential loss. You could lose all the money in your account (plus any amount available in a linked overdraft line of credit/savings account). If you tell us within two (2) business days after you learn of the unauthorized electronic fund transfers from your account, you can lose no more than $50.00 if someone accessed your account without permission.
If you DO NOT tell us within two (2) business days after you learn of the unauthorized electronic fund transfer(s) from your account and we can prove that, with prior notice from you, we could have stopped someone from completing such transfer(s) without your permission, you could lose as much as $500.00 or more depending on when you notify us of the error.
If your statement or electronic notification of transfer shows transfers that you did not make, tell us at once. If you do not tell us within sixty (60) days after the date the statement or notification was mailed to you, you will be liable for up to $500.00 of loss that occurred during the sixty (60) day period. You may not get back money lost after the sixty (60) days if proven that we could have stopped unauthorized transfers with a notice from you within the (60) days. If a good reason (such as long trip or hospital stay) kept you from telling us, we may extend the time periods to a reasonable time.
If you believe that someone has transferred or may transfer money from your account without your permission, because you believe your Login ID and Password have been lost, stolen, or money is missing from your account(s), contact Kish Bank immediately.
Types of Services – You may access your account(s) via the Internet by logging onto our website at www.kishbank.com and using your UserID and Password to:
- Transfer funds between checking, statement savings, money market, and line of credit accounts;
- Make payments from checking and statement savings accounts to loan account(s) within Kish Bank;
- Make payments from checking accounts only to third parties using our bill payment service;
- Get information about the account balance of your checking, money market, statement savings, certificate of deposits and loans account(s);
- Get information about deposits and withdrawals on your checking/money market and/or statement savings account;
- Sign up to begin receiving your account statements via electronic delivery.
Transaction Resulting in Overdrafts – If we permit a funds transfer transaction or bill payment transaction to create an overdraft on your account, the overdraft fees listed on our Service Charge Fee Schedule will apply.
Limitations on Frequency of Transfers – You may authorize any number of electronic funds transfers of the types outlined from checking to your savings account. Electronic funds transfers from your savings account are limited to only six (6) or fewer per month and only to your other accounts with Kish Bank or to Kish Bank for loan payments. You may authorize any number of electronic funds transfers of the types outlined from your checking to your Indexed Cash Fund. Electronic funds transfers from your Indexed Cash Fund are limited to six (6) or fewer per month. These transfers include any telephone transfers made from your Indexed Cash Fund to your checking account with us or any payments to us or others made at substantially regular amounts and intervals or any checks you write against your Indexed Cash Fund. The information necessary to conduct telephone transfers from your Indexed Cash Fund is provided to you when you open this type of account.
For security purposes, there may be limits on the number and dollar amount of electronic transfers you can make.
Prohibited Payments – Payment to payees outside of the United State or its territories; Guam, Puerto Rico, and U.S. Virgin Islands are prohibited through Consumer OnLine Banking Bill Payment services.
Exception Payments – Bill payments can be made to any government agency; IRS, taxes, child support, court fees, etc; however, such payments are discouraged and must be scheduled at your own risk. In no event shall Kish Bank and the Consumer OnLine Banking Bill Payment services be liable for any claims or damages resulting from you scheduling these types of payments. The Bank’s promise as it applies to any late payment related charges is void when these types of payments are scheduled or processed by Consumer OnLine Banking Bill Payment services.
Statements and Notification – You will receive a monthly account statement showing your electronic funds transfers if you had any during your statement period. You will also receive online notification via electronic mail of any Consumer OnLine Banking bill payments. If you wish to enroll to receive your monthly account statements via Consumer OnLine Banking, you may enroll through the customer service tab via Consumer OnLine Banking. You must agree to the OnLine Statement disclosure prior to completing the enrollment process.

Contact us promptly if you think your statement is wrong or if you need more information about a transfer or bill payment listed on your electronic mail notification of transaction or account statement. YOU MUST CONTACT US ONLY AT THIS TELEPHONE NUMBER OR ADDRESS ABOUT YOUR ERRORS OR QUESTIONS. We must hear from you no later than sixty (60) days after we sent you the FIRST electronic mail notification of transaction or statement on which the problem or error occurred.
Please let us know the following information when you suspect an error:
- Tell us your name and account number;
- Describe the error or transfer you think is incorrect, and clearly explain why you believe it is an error or why you need more information;
- Tell us the dollar amount of the suspected error and, if possible, the date it appeared on your statement or you received a notification of transaction via electronic mail;
- It will be helpful to us if you also give us a telephone number at which you can be reached in case we need any further information;
- If you notify us by phone, we have the right to require you to send us your complaint in writing within ten (10) business days following the date you notified us.
We will report to you the results of our investigation within ten (10) business days following the date you notified us. We will correct any error promptly. If we need more time, however, we may take up to forty-five (45) business days to investigate your complaint or questions following the date you notified us. If we decide to use more time to investigate, within ten (10) business days following the date you notified us, we will credit your account for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or questions in writing and we do not receive it within ten (10) business days following your notification by phone, we may not credit your account.
If we decide that there was no error, we will send you a written explanation within three (3) business days after we finish our investigation. You may ask for copies of the documents that we used in our investigation.
Our Liability – If we do not complete a transfer to or from your account on time or in the correct amount according to our agreement with you, we will be liable for your losses or damages. However, there are some exceptions. We will NOT be liable, for instance, if:
- Through no fault of ours, you do not have enough money in your account to make the transfer;
- The transfer would go over the credit limit on your overdraft line/account, if applicable;
- Circumstances beyond our control such as fire or flood prevent the transfer; despite reasonable precautions we have taken;
- The funds in your account are subject to legal process or other encumbrance restricting the transfer;
- We are holding uncollected funds in your account and the transfer would require the use of those funds;
- We have restricted or refused your transactions for security reasons;
- There may be other exceptions stated in our account agreement(s) with you.
Stop Payments – You authorize Kish Bank to accept stop payment orders that you request through Consumer OnLine Banking, and agree that information that is electronically transmitted shall be sufficient evidence to establish or renew a stop payment order. This shall be deemed the equivalent of a written stop payment order and can be printed for your records or retrieved electronically.
We will send notification via U.S. mail to you within five (5) business days confirming the stop payment request. If notification is not received, it will be your responsibility to telephone our Customer Service Department to ensure that the stop payment order has been placed. A copy of the stop payment request may be obtained by contacting Customer Service at 717-667-9800 or 1-800-981-5474. The stop payment order is effective six (6) months unless renewed in writing, through your branch office or Customer Service. A stop payment order must specifically identify the number, date, payee and amount of the item and must be received by the Bank in enough time to give us reasonable opportunity to act on it. You agree that in the event your stop payment order is incomplete or inaccurate, the bank may be unable to process the stop payment. You further agree that, unless the Bank has a reasonable time to act on your stop payment order prior to payment of an item, the Bank will be unable to stop payment. By initiating a stop payment order, you agree to indemnify and hold us harmless from and against any claim arising in connection with our refusal to pay such item as well as on other suits, damages, liability, expenses and costs.
If you issue a stop payment order on a recurring payment this will no way cancel the companies’ right to debit your account. You must contact the originator to cancel your authorization agreement.
Electronic Mail - If you send the Bank an electronic mail message, we will have a reasonable time to act on your electronic mail. You should not rely on electronic mail to communicate with Kish Bank, for example, if you need to report an unauthorized transaction on your account(s).
You agree that we may respond to you by electronic mail with regard to any matter related to Consumer OnLine Banking and Bill Payment services, including responding to any claim of unauthorized electronic funds transfers that you make. Any such electronic mail sent to your by the Bank shall be considered received within three (3) days of the date sent by us, regardless of whether or not you signed on to Consumer OnLine Banking and Bill Payment services within that time frame.

Inactivity/Termination – You are responsible for complying with all the terms of this Agreement and with the terms of the agreement governing the deposit account(s) which you access using Consumer OnLine Banking and Bill Payment services. We can terminate your electronic banking privileges (Consumer OnLine Banking and Bill Payment services) under this Agreement without notice to you if you do not pay the fee required by this Agreement when due or if you do not comply with the Agreement governing your deposit or loan account(s) or your account(s) are not maintained in good standing. We will promptly notify you if we terminate this Agreement or your use of the services for any other reason than stated above.
If you are not paying a monthly service fee for Consumer OnLine Banking or Bill Payment, the Bank may deactivate your account if you do not sign on to Consumer OnLine Banking or schedule any transactions through Consumer OnLine Banking Bill Payment during any consecutive 120 day period. At one hundred twenty (120) days if you have not used Consumer OnLine Banking and Bill Payment feature, the service will be terminated.
Cancel Consumer OnLine Banking/Bill Payment – You must notify the Bank and provide your name; address; whether you are discontinuing Consumer OnLine Banking, Bill Payment or both; and the effective date to stop the service. When Bill Payment is terminated, any prescheduled bill payments made through Consumer OnLine Banking and Bill Payment will also be terminated. If applicable, the final charge for your Bill Payment service will be assessed at the end of your statement cycle. You may notify the Bank by one of the following methods:

Amendments – We may change or terminate this agreement at any time. We will mail you advance notice of the change at least twenty-one (21) days before it takes place if the change is the charging of or increase of a fee, an increase in your liability, fewer ways you can use our Electronic Funds Transfer (EFT) services or stricter limitations on EFT use. No prior notice is necessary if the change is for security reasons.
